Terms and Conditions – Immoprice SA
1. Scope of Application
These Terms and Conditions (T&Cs) apply to all services provided by Immoprice SA, Rue de Romont 20, 1700 Fribourg (hereinafter "Immoprice"), via the website www.immoprice.ch, relating to the connection between property owners and third-party real estate brokers. By using our platform or services, the user expressly agrees to these terms.
2. Description of Service
Immoprice offers an online tool allowing users to obtain an estimate of their property's market value. After the estimation, Immoprice forwards the owner's contact details and property information to one or more partner real estate brokers who may offer their services.
Immoprice is not a real estate broker and does not participate in the negotiation or conclusion of any contract between the owner and the broker. Immoprice acts solely as a technical and commercial intermediary.
3. User Obligations (Property Owners)
- The information provided (personal and property-related) is accurate and up to date;
- They are authorized to offer the property for sale (as owner or legal representative);
- They consent to the transmission of their data to third parties for the purpose of being contacted.
Users remain free to accept or decline any offer made by brokers. There is no obligation to sign any mandate following the connection.
4. Broker Obligations
Third-party real estate brokers receive leads from Immoprice at their own risk. No formal subcontracting or exclusivity agreement is established between Immoprice and these brokers. It is the brokers' responsibility to comply with applicable regulations, particularly regarding solicitation, confidentiality, and data protection.
Immoprice does not guarantee either the exclusivity or the quality of the leads provided.
5. Billing Terms
- Partner real estate brokers are charged for each lead provided (per-lead pricing, bundle offers, or subscription, depending on the agreement);
- Property owners may, depending on the chosen offer, access free services (e.g., automated valuation) or paid services (e.g., detailed and personalized valuation, market analysis, downloadable report, etc.).
Applicable prices are clearly indicated before any order is placed on the site. Any order for a paid service by a property owner is considered firm and non-refundable.
Invoices must be paid within 30 days of issuance unless otherwise agreed. In case of late payment, an interest rate of 5% per annum may apply in accordance with Article 104 of the Swiss Code of Obligations.
6. Limitation of Liability
Immoprice disclaims all liability in the following cases:
- No agreement is concluded between the property owner and a broker;
- Indirect damages, loss of profits, or harm resulting from the use of our services;
- Technical issues linked to the platform or third-party providers.
Immoprice’s liability is limited to the amount paid by the broker for the lead concerned, except in cases of willful misconduct or gross negligence.
7. Intellectual Property
All content on the site (texts, design, interface, logos, etc.) is protected by copyright and remains the exclusive property of Immoprice. Any unauthorized reproduction, distribution, or use is strictly prohibited.
8. Data Protection
The processing of personal data is governed by our Privacy Policy. Users acknowledge that their data may be transmitted to third parties (brokers) solely for the purpose of providing the described services.
9. Governing Law and Jurisdiction
These Terms and Conditions are governed by Swiss law. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the courts of Fribourg (Switzerland).
10. Changes
Immoprice reserves the right to modify these T&Cs at any time. The version in force is the one published on the website at the time of service use.
